These terms are the agreement between you and APMTV LLC ("we", "us") for the use of TOM at asktomfirst.com. By subscribing or signing in, you agree to them. They are written in plain English on purpose.

1. What TOM is, and what it is not

TOM is a screening tool. It estimates what a property might appraise for, what a renovation might cost, and what the property might earn as a rental, so you can decide which deals deserve a closer look.

TOM is not an appraisal, not a contractor bid, not a lending decision, and not financial, investment, tax or legal advice. Its numbers are estimates produced by software from third-party data. Before you commit money to any property, get a licensed appraiser, a real contractor bid, and your own lender. Do not treat any number TOM produces as a promise.

We are not licensed appraisers, real estate brokers, investment advisers or financial advisers, and nothing in TOM creates any such relationship between us.

2. The data is imperfect, and sometimes wrong

TOM's property information and comparable sales come from third-party providers. That data is frequently incomplete, out of date, or simply incorrect — square footage, bedroom counts and tax figures from public records are wrong often enough that TOM lets you correct them. Renovation costs are modelled from state and metro construction averages, not quotes. Property tax, insurance and closing costs are state averages wherever the public record has no figure for the address. Rental income figures are projections, and the short-term and mid-term rent figures in particular are modelled rather than sourced.

We do not warrant that any of it is accurate, complete or current.

4. Fair use

Each subscription includes a monthly allowance of property analyses, shown in the app. Re-opening a property you have already analysed does not count against it.

You may not scrape TOM, automate it, resell its output as your own product or data feed, or use it to build a competing service. The property data behind it is licensed to us for use in TOM and not for redistribution.

We may suspend an account that is being shared, automated, or used in a way that runs up costs far beyond normal individual use. Where it looks like a mistake rather than deliberate abuse, we will contact you first.

If TOM is not what you expected, email admin@asktomfirst.com within 14 days of your first payment and we will refund it in full.

After that, payments are non-refundable, and cancelling stops future charges rather than refunding past ones. We will still look at anything that has genuinely gone wrong — a double charge, a subscription that failed to cancel — and put it right.

7. Availability

We try to keep TOM running and accurate, but it is a small product run by a small business. It may be unavailable for maintenance, because a data provider is down, or because something broke. We do not guarantee any particular uptime, and we may change or remove features.

8. Your responsibility, and the limit of ours

Every decision you make about a property is yours. You are responsible for verifying anything TOM tells you before acting on it, and for the consequences of buying, renovating, refinancing or renting any property.

To the fullest extent the law allows, we are not liable for any lost profit, lost opportunity, or any indirect or consequential loss arising from your use of TOM — including a property that appraises below TOM's estimate, a renovation that costs more than TOM predicted, or rental income that falls short of TOM's projection. Our total liability to you, for any claim, is limited to what you paid us in the twelve months before the claim.

Some jurisdictions do not allow certain limitations, so parts of this may not apply to you. Nothing here limits liability for fraud.

9. Who owns what

TOM, its code, its models and its wording belong to us. Your subscription buys a personal, non-transferable right to use it while your subscription is current. Reports you generate are yours to use in your own investing and to share with your lender, agent or contractor.

10. Ending it

You can stop at any time by cancelling. We may end or suspend your access if you break these terms, and will refund any unused portion where you have not been abusing the service.

11. Changes to these terms

We may update these terms. The date at the top shows when. For any change that materially affects you, we will email subscribers. Continuing to use TOM after a change means you accept it.

12. Law

These terms are governed by the laws of the State of New York, and any dispute will be handled in the courts of New York.
